Canada Work Permit /LMIA Scam Alert!!!

Once again I’m being asked by clients about converting a visitor visa to a Canada work permit as they plan to apply for a visitor visa and then convert to a work permit.

If you’re also thinking along these lines, I’d like to say to you, “Wait.” That’s not how it works. Please read this article to understand the process.

Can someone with a visitor visa legally apply for a work permit in Canada?

The answer is yes! But what are the requirements? Many people have a misconception about this, or it’s presented that way in the marketplace, overlooking the most important aspects of the LMIA process. Below you’ll learn how to apply for a work permit.

ELIGIBILITY CRITERIA
To apply for work permits inside Canada under a visitor visa status

Have valid immigration status in Canada (tourist visa).
Secure a legitimate job offer that is supported by a labor market impact assessment (LMIA) or an LMIA-exempt offer of employment.
Submit your application by February 28, 2025.

What is a Labour Market Impact Assessment?

A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker.

A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job. A positive LMIA is sometimes called a confirmation letter.

If the employer needs an LMIA, they must apply for one.

Once an employer gets the LMIA, the worker can apply for a work permit.

To apply for a work permit, a worker needs
a job offer letter
a contract
a copy of the LMIA, and
the LMIA number

To summarise:

It’s a myth when someone claims that you can simply convert a visitor visa into a work permit. If that were true, wouldn’t everyone have gone to Canada and stamped their work permit, right? Why go through Express Entry? Why wait in the pool for 3-4 years now?

It’s also a myth when someone says ‘Pay us 20-30 lakhs and we’ll get you the work permit while you’re in Canada on a visitor visa’ Well, a work permit isn’t a business where someone sells something and you buy it. Unfortunately, Canada hasn’t defined any such illegal process!

Be smart, be vigilant, be aware! All the information is on the government websites. There is no point in blaming anyone; it’s your hard earned money at stake before you get involved in anything to do with illegal immigration routes or work permits!
